By purchasing ticket(s), you agree to these terms and conditions as stated and to this release of all claims, waiver of liability, and assumption of risk (“Waiver and Release”). You waive any and all claims you may have now and in the future and release from all liability and agree not to sue Charleston Tour Group LLC, its DBAs (Chucktown Tours, Blueberry Tours, and Blue Hippo Tours), its officers, agents, representatives, employees, or independent contract tour guides [hereafter referred to as “Staff”].

You acknowledge that Charleston Tour Group LLC is not liable for any personal injury, death, property damage, or loss sustained as a result of your participation in a tour or experience offered by Charleston Tour Group LLC, due to any cause whatsoever, including without limitation, negligence on the part of Charleston Tour Group LLC, its Staff, tour partners, or other participants, or due to risks associated with war, civil unrest, or epidemic.

If you violate this agreement and attempt to bring suit against any parties named herein, you will be held responsible for attorney’s fees and any costs incurred by that party in defending such action.

You acknowledge that the tours and events offered have inherent risks beyond the usual dangers, including but not limited to physical exertion for which you may not be prepared and weather extremes subject to sudden and unexpected change. You accept all inherent risks of the proposed tour, including the possibility of personal injury, death, or property damage or loss resulting therefrom.

You further acknowledge that part of the enjoyment and excitement of the tour or event is derived from these inherent risks, and you willingly choose to participate. If you suffer injury or illness, Charleston Tour Group LLC or its Staff may, at your cost, arrange medical treatment and emergency evacuation services as deemed necessary for your health and safety.

At all times during the tour, you agree to comply with any additional instructions given by your tour guide or other Staff. Non-compliance may result in injury, death, permanent disability, or removal from the tour without refund.

You affirm that you are not relying on any oral, written, or visual representations by Charleston Tour Group LLC, its Staff, or any other inducement to participate in the tour. By your own free will, you confirm that you have read and understood this Waiver and Release and agree that it is binding upon your heirs, next of kin, executors, administrators, and successors.

You grant Charleston Tour Group LLC a worldwide, royalty-free license to use your photographic, video, or digital likeness, or those which you provide, solely for promotional, educational, and/or commercial purposes.

As a tour participant, you accept full responsibility for your behavior, well-being, and health, acknowledging that tours may involve physical activities such as climbing, running, or walking for extended periods. You further acknowledge that tours may take place on unfamiliar, narrow, unpaved, or steep paths, gangways, roads, stairways, and driveways.

You knowingly and willfully accept these risks and assume complete responsibility for your behavior, well-being, and health. You agree to hold neither Charleston Tour Group LLC, nor its Staff, nor any facility liable for any harm that may come to you.

Tour Cancellation Policy:

• No tour will be refunded when canceled within seven (7) days of the tour date, unless deemed an extraordinary circumstance by Charleston Tour Group LLC.
• If a tour is canceled within the seven (7) day no-refund period, tour tickets will remain valid for one (1) year from the originally booked tour date or may be transferred to a party of your choosing within that timeframe.
• No refunds will be issued for rain or inclement weather unless Charleston Tour Group LLC cancels the tour.
• No refunds will be provided for late or “no-show” parties. While every reasonable effort will be made to communicate with late arrivals, it is the responsibility of the participant to ensure timely attendance.
• Any and all refunds, reassignments, or rainchecks remain at the sole discretion of Charleston Tour Group LLC and are in no way guaranteed.

By purchasing ticket(s), you affirm that you have fully read, understood, and agree to these Terms and Conditions, Waiver, and Release of Liability.
